Terms of Service

These Terms of Service ("Terms") govern your use of the InkEthos application and website (the "Service"), operated by the InkEthos app owner, based in California, United States. By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 18 years old and legally able to enter a contract. The Service is intended for professional tattoo artists and their studios.
2. Accounts
You are responsible for the security of your account and for every action taken under it. Notify us immediately at behindblueeyes927@gmail.com if you suspect unauthorized access.
3. Subscription plans and billing
Paid plans are offered as auto-renewing monthly subscriptions:
- Solo Artist — $29 USD per month.
- Multi-Artist Studio — $79 USD per month (up to 6 artist workspaces).
New accounts include a 14-day free trial. If you do not cancel before the trial ends and you have added a payment method, your subscription will begin and your card will be charged at the then-current price. Subscriptions renew automatically each month until you cancel. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Except where required by law, fees are non-refundable.
Prices may change with at least 30 days' notice via email or in-app notice; continued use after the change means you accept the new price. Applicable taxes may be added at checkout.
4. Your content and data
You retain ownership of the client, booking, portfolio, and consent records you enter into the Service ("Your Content"). You grant us a limited license to host, store, and display Your Content solely to operate the Service for you. You are responsible for having the legal right to upload any client information, ID data, and portfolio photos.
5. Guest consent records
When a guest fills out a consent form on your tablet, you are the party collecting that information from the guest. You are responsible for complying with state tattoo record- keeping requirements, health code rules, and applicable privacy laws in your jurisdiction. We provide the tooling; the professional-client relationship is yours.
6. Acceptable use
- No illegal, harassing, or infringing use.
- No reverse engineering, scraping, or abusing the Service.
- No uploading of malware or attempts to access other users' data.
- Do not use the Service to store data you are not legally allowed to collect.
7. Service availability
We work to keep the Service running, but we do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue features at any time.
8. Disclaimers
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non- infringement. Tax estimates, ID-scan results, and other automated outputs are provided for convenience only and are not professional legal, tax, or medical advice.
9. Limitation of liability
To the maximum extent permitted by law, InkEthos and its operator will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or business opportunities. Our total liability for any claim arising out of or relating to the Service is limited to the amount you paid us in the 12 months before the claim, or USD $100, whichever is greater.
10. Indemnity
You agree to indemnify and hold harmless InkEthos and its operator from any claims arising out of Your Content, your use of the Service, or your violation of these Terms or applicable law (including tattoo licensing, health code, and privacy laws in your state).
11. Termination
You may stop using the Service at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your right to use the Service ends immediately; data may be deleted after a reasonable retention period.
12. Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in California, and you consent to their jurisdiction.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Continued use after changes means you accept the updated Terms.
